These Terms of Service (“Terms”) govern your access to and use of KinoCloud (the “Service”), operated by Sister, Renold Building, 32a Altrincham St, Manchester, M1 7JR, UK. By creating an account or using the Service, you agree to be bound by these Terms.
You are responsible for safeguarding the credentials and API keys used to access the Service and for all activity that occurs under your account. Notify us promptly of any unauthorised use. You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.
You agree not to use the Service to violate any applicable law, infringe intellectual property rights, distribute malware, attempt to gain unauthorised access to systems, or run workloads that compromise the integrity, security, or availability of the Service or the underlying GPU infrastructure.
You retain all rights to the assets, scenes, and data you submit for rendering or compute (“Content”). You grant us a limited licence to process, store, and transmit your Content solely to operate the Service. You are responsible for ensuring you have the rights to all Content you submit.
Paid usage is billed through our payment processor on a usage or subscription basis as described at checkout. Compute credits and charges are non-refundable except where required by law. You authorise us to charge your selected payment method for all fees incurred.
The Service relies in part on preemptible and spot compute capacity, which may be reclaimed at short notice. When an interruption occurs, in-progress work is automatically re-queued and retried, and long render jobs resume from the last completed frame where the renderer supports it. We do not guarantee that in-progress work is preserved without loss, that jobs complete within any particular time, or that availability is uninterrupted, and we provide the Service on an “as is” and “as available” basis.
To the fullest extent permitted by law, Sister shall not be liable for any indirect, incidental, or consequential damages, or for loss of data, profits, or compute output, arising from your use of the Service. Our aggregate liability is limited to the amounts you paid in the twelve months preceding the claim.
We may suspend or terminate access to the Service for breach of these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
